The following statement discloses privacy practices for all of the websites of Force10 Networks, Inc. and its subsidiaries (“Force10”). This privacy policy is effective as of March 1, 2008, though Force10 may update this policy at any time without notice, so please check back periodically. All updates will be published at www.force10networks.com.

What Information is Collected

We may request personally identifiably information from you when you place an order with Force10, register a product, request or sign up for a service or support, respond to a Force10 survey, enter a contest, correspond with Force10, or engage in other activities on Force10 websites. When you submit an order with Force10, for example, we will ask you for information necessary to complete the transaction, such as your name, address, contact information, and payment information. Providing such information is completely voluntary, and you are under no obligation to provide any information to Force10, but if you decide not to share such information with us, we may not be able to provide the requested products and/or services.

How Information is Used

If you agree to provide us with personally identifiable information, we will use it in the following ways: (1) To help us create content that is relevant to you; (2) To provide you with special offers that may be of interest to you; (3) To assist us in developing better products and services to better meet your business needs; (4) To allow you to purchase and download products, register for and obtain access to services and/or support, or otherwise engage in activities you select at our websites; (5) To provide you with information about new products, services, support, and newsletters; and (6) To help you find product and support information that may be important to you.

How Information Is Shared

Force10 will not rent or sell your personally identifiable information to any third party. From time to time, however, unless we have stated otherwise, we may provide information to our business partners in order to effectively provide the product and/or service you have requested. In addition, Force10 may retain the services of contractors to provide services for us, for example, to ship products, provide support, or perform other services for us. We require that our contractors keep the personally identifiably information of our customers confidential. We also require that these contractors use personally identifiable information only on behalf of Force10. Please be advised that in certain instances, it may be necessary for Force10 to disclose your personally identifiable information to government officials or otherwise as required by law. In addition, since Force10 has a global presence, we do provide company information to our worldwide offices, and as such, the personally identifiably information that you provide to us may be transferred to other Force10 offices around the world. For example, when customers in Europe register products or for support, their personally identifiable information may be transferred to servers in the U.S. and then transferred to servers in one or more of Force10's offices in Europe.

Opt-Out

Force10 provides a number of ways for you to “opt-out” of receiving information from us, participating in any programs that you register for, or having us provide your personally identifiable information to our business partners. We may offer you these choices at the time you give us your information. If you are at a Force10 website that requires personally identifiably information but does not offer communication options, or you would like to change your preferences for information that you have previously provided, please use one of the communication methods listed below. If you do not wish to continue receiving any e-mail or newsletters we may send to you, you can opt-out of receiving these communications by replying to the unsubscribe link in the subject line in the e-mail.

Correcting Your Personally Identifiable Information

If you provide us with personally identifiable information to have us perform services for you, usually we will provide you with a way to review the information we have on file and either change or remove such data. To do so, please notify us via postal or e-mail at the address below and we will provide you with your contact information for review. To make changes, send us the changes. Unfortunately, to the extent that such information is also stored in other databases, we cannot always ensure that such corrections or deletions will reach the other databases. If you wish to have information you provided to us online removed from our records, please provide us with the information as you submitted it to us at the address below, and we will use all reasonable efforts to ensure that your information is removed from our records.

Security

Force10 uses industry-standard methods to protect your personally identifiable information from unauthorized access. Among other techniques, we generally store such information on a computer behind our “firewall” in a secure location, and we often restrict the number of employees internally who can access such data. Of course, there is no such thing as “perfect security” on the Internet.

Cookies

When you visit our websites, we might store some information on your computer. This information will be in the form of a “cookie” or similar file. Cookies are small pieces of information stored on your hard drive, not on our website. Cookies do not spy on you or otherwise invade your privacy, and they cannot invade your hard drive and steal information. Rather, they help you navigate a website as easily as possible. Cookies can help us provide information that is better meets your business needs and they allow us to better understand how customers use our websites, which in turn helps us focus our resources on features that are most popular with our customers. You are always free to decline our cookies if your browser permits, but some parts of our website, including our registered customer websites, may not work properly in that case

This privacy policy only addresses our activities from our servers. Other websites including those that we link to within our websites, or within an article, advertisement, or otherwise, and third party websites with which we co-brand, may have their own policies, which we do not control, and thus are not addressed by this privacy policy. In addition, at Force10 websites, we may list business partners with whom we have a relationship. Force10 is not responsible for the privacy practices of our business partners, so if you decide to link to or visit their websites, we encourage you to read their privacy policy statements, as they may differ from our privacy policy.

Forums and Discussion Groups

Please be aware that any information you submit in a discussion group or forum will be deemed public information and will not be treated as confidential. Please be aware that communication and information may be collected and used by others within these groups or forums, so please be careful when you are online.

Children

Children are not eligible to purchase or use our products and/or services, so we ask that minors do not submit any personally identifiably information to us via our websites or otherwise.
